E-government: electronic delivery

About this practice area

Electronic delivery of correspondence is the method used today for communicating in business and when dealing with public bodies. The conventional method of serving documentation and legal correspondence as hard copies is giving way to secure digital channels.

E-Delivery is expected to become the common norm, in particular in relations with public bodies. In the future, e-Delivery may also become an element of commercial operations and be used to communicate with business partners and consumers.

Entities covered by the e-Delivery system – public bodies, professions of public trust, and business undertakings – will face the task of complying with the new legislation. As a law firm that focuses on new technologies, TKP helps the parties concerned to be properly prepared for the switch to e-Delivery, looking at the legal risks and the requirements, and how to ensure that documentation that reaches an organization is processed smoothly.

What we do?
  • We provide assistance with analysis of requirements under the e-Delivery Act, in view of the legal nature of a particular entity.
  • We advise on options as to use of e-Delivery in business activity and dealings with public bodies.
  • We assist with the drafting of internal documentation to comply with the requirements of the e-Delivery Act and special provisions of law.
  • We help to transform business processes due to a switch to e-Delivery.
  • We provide training and awareness sessions for employees, on the switch to e-Delivery, tailored with regard to scope, content, and means of communication to the addressees (management, lawyers, employees dealing with business/areas of expertise, technical and IT employees).
  • We assist with drafting the information security and data protection documentation relating to the switch to e-Delivery.
  • We devise and implement in full the procedure for drafting the documentation needed to begin performing registered e-Delivery as a qualified service, for firms that wish to begin providing these services as part of their business operations; we also provide assistance at the regulatory level, drafting the terms of service, document templates, service policies and similar, and advise on the switching process, including in relation to an audit, where applicable.
Cooperation benefits

The switch to e-Delivery is not solely a matter of compliance with the e-Delivery Act; this could be an essential element of digitalization of the organization.

For this reason, experts at TKP do more than produce document templates; they create lists of recommendations and identify areas with potential to be organized to complement these actions. We take a holistic approach to every project, to account for the specific nature of the organization and business sector concerned.

The assistance we provide includes a proactive implementation team. We play a part in both the drafting of legal documentation and analysis and conceptual work. We will conduct a thorough analysis of documents concerning standards, guidelines, and requirements essential for launching and distributing products and services. Our role also includes gaining an in-depth understanding of the technological aspects, and detecting legal risks and explaining how to mitigate them.

Why choose us?

E-Delivery will be used in an array of matters: administrative issues with numerous public bodies and social security matters, and, in the future, civil and criminal law and proceedings as well. Due to our specialist know-how, we are able to analyze the legal risks faced by an organization in every sphere in which e-Delivery is used.

We have advised nearly one hundred entities on implementation and technological projects and on data protection issues. We are experienced in advising entities that provide electronic identification, trust, and paperless products and services.
