Bio

Rafał Klimek specializes in civil, administrative and copyright protection law, with a focus on assisting in the investment process and real property trade. He has many years’ experience in court proceedings before administrative bodies, courts, and arbitration tribunals. In particular, he represents investors in matters of legality of planning decisions, litigation relating to implementation of investments, and in issues related to copyright infringement in the investment process. He advises on acquisition of real property, obtaining decisions prior to proceeding with the investment process, and creation of corporate structures intended for the optimization of investment projects.

At TKP, he is head of the Real estate, construction projects and infrastructure law team and is also responsible for projects in the Environmental Protection practice. In addition, he participates in the work of the Dispute Resolution and Arbitration as well as Commercial Law and Corporate Advisory teams.

He is a speaker at conferences and training courses on legal due diligence of real estate and copyright issues related to design documentation and investment processes. He has delivered training for, among others, the Polish Association of Developers, Bank Gospodarstwa Krajowego (BGK), and Puls Biznesu. He is also an author of academic publications in the field of private, civil, and international law.

He is a graduate of the Faculty of Law and Administration at the Jagiellonian University, and completed his PhD at the Department of Civil Law at the Jagiellonian University. He also completed postgraduate studies at the Cracow School of Business in the domain of Project Management at the Cracow University of Economics.

Openness of development real estate prices - amendment to the Development Act 2025

On 21 May 2025, the Sejm adopted an amendment to the Development Act, which aims to increase transparency in the real estate market and better protect buyers of dwellings and houses. The new regulations introduce, among others, an obligation of open publication of the prices of premises on developers’ websites, which should prevent unfair practices and facilitate comparing of offers. The amendment introduces new obligations for developers, in particular the requirement to disclose real estate prices. This will translate into new administrative and organisational challenges for companies operating in the development industry. Foreign entities planning to enter the Polish market will have to adapt their current practice to Polish regulations, which may have a direct impact on their existing business strategies.
