Bio

At TKP, Klaudia works in the Real Estate, Property Development and Restitution, and Environmental Protection teams.

Klaudia’s practice focus is a broad range of civil law issues – concerning both substantive law and litigation – in particular real estate and property development issues. She works on real estate, property development, and environmental protection projects, and on judicial and administrative proceedings as well.

Klaudia has gained vast experience in advising businesses on a full range of issues through working for instance on judicial and administrative proceedings, conducting due diligence reviews relating to real estate and transactions, and dealing with regulation of the legal status of real estate. She draws up agreements and legal opinions on civil, administrative, and commercial law.

She developed her experience working in law firms in Krakow specializing in corporate legal services, real estate law, and intellectual property law.

Klaudia studied at the Faculty of Law and Administration at the Jagiellonian University, and also completed a postgraduate course on real estate appraisal at the Krakow School of Business, part of the Krakow University of Economics. She is registered as an attorney-at-law with the Cracow Bar Association.

Klaudia speaks fluent English.

Transparency of Real Estate Prices – Amendment to the Developer Act 2025

On 11 September 2025, an amendment to the Developer Act entered into force, providing for new requirements for developers. One of these requirements is to maintain websites stating the date of sale or the conclusion of the first reservation agreement, and the prices per square meter of each residential unit or single-family house on offer. Websites must also state the prices of the entire property or the relevant parts covered by the agreement. The published prices must correspond to those set out in the developer agreement and must include VAT.

Openness of development real estate prices - amendment to the Development Act 2025

On 21 May 2025, the Sejm adopted an amendment to the Development Act, which aims to increase transparency in the real estate market and better protect buyers of dwellings and houses. The new regulations introduce, among others, an obligation of open publication of the prices of premises on developers’ websites, which should prevent unfair practices and facilitate comparing of offers. The amendment introduces new obligations for developers, in particular the requirement to disclose real estate prices. This will translate into new administrative and organisational challenges for companies operating in the development industry. Foreign entities planning to enter the Polish market will have to adapt their current practice to Polish regulations, which may have a direct impact on their existing business strategies.

New EPR concept 

Extended Producer Responsibility (EPR) was implemented by Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste. Its aim is to strengthen waste prevention, reuse, recycling and other forms of recovery. It provides for the introduction of rules imposing extended producer responsibility on all product manufacturers1 by Member States. This means that producers bear financial and organisational responsibility for the waste generated by their products.

A step closer to perpetual usufruct being abolished in Poland

Perpetual usufruct is title to use state-owned or local-government-owned real estate. The owner grants perpetual usufruct of the property for a period that is usually 99 years, for an annual fee. The annual fee for perpetual usufruct is laid down in law, and is between 0.3 – 3% of the price of the real estate, depending on the purpose for which perpetual usufruct is granted.
