Bio

Agnieszka specializes in copyright law, with particular emphasis on issues related to collective management organizations, as well as in unfair competition law and civil law. She has more than fifteen years of experience in handling legal cases and assisting in alternative resolution of disputes related to application of copyright law. At the Law Firm, she is in charge of the Team for Copyright and other Rights related to Intangible Assets, which is part of the Intellectual Property Law Practice.

Agnieszka Schoen is the author of “Poszukiwanie prawnej ochrony tzw. formatów telewizyjnych na gruncie prawa autorskiego oraz prawa zwalczania nieuczciwej konkurencji” [“Searching for legal protection of TV formats based on copyright and  the Law on Combatting Unfair Competition”] in Zeszyty Naukowe Uniwersytetu Jagiellońskiego. Prace Instytutu Prawa Własności Intelektualnej. Zagadnienia prawa własności intelektualnej [Scientific Papers of the Jagiellonian University. Works of the Intellectual Property Law Institute. She is a graduate of the Faculty of Law and Administration at the Jagiellonian University.

A autonomic liability regime for online content-sharing service providers under article 17 of the DSM Directive is not a breach of freedom of expression and information - CJEU judgment of 26 April 2022 (C-401/19)

On 26 April 2022, the CJEU Grand Chamber issued a much-awaited judgment in a case brought by Poland concerning article 17 of the DSM Directive. The complaint was rejected on formal grounds with regard to the main plea, which sought annulment of article 17(4), point b and point c in fine of the DSM Directive, and dismissed as being without merit with regard to the other issues, i.e. annulment of article 17 in full.
