Bio

Kaja’s practice focus is copyright and industrial property law, and specifically trademark disputes. Kaja also has extensive experience in defending personality rights, influencer marketing, and combating unfair competition.

She developed her professional experience at law firms in Lublin and Warsaw, providing corporate housekeeping for clients in the FMCG, cosmetics, automotive, apparel, and other sectors.

Kaja has worked on cases before the European Union Intellectual Property Office (EUIPO), the Polish Patent Office, common courts, and the World Intellectual Property Organization (WIPO) on international trademark registration cases.

She is currently studying for the bar with the Warsaw Bar Association, and is a graduate of the Intellectual Property School at the H. Grocjusz Intellectual Property Centre in 2021.

In 2023, she completed the “CopyrightX” – copyright law course organized by Harvard Law School and the Berkman Klein Center for Internet and Society, and passed the final exam.

Kaja studied law at the Maria-Curie Skłodowska University in Lublin. While studying, she attended numerous national academic conferences, including “Mediation and arbitration intellectual property cases”, “New technologies law”, and “New technologies and development of the information society – a challenge for lawmakers”. Kaja was awarded the Maria-Curie Skłodowska University prize for the best thesis on alternative dispute resolution. While studying she qualified as a data protection officer.

(Non-)obvious assessment of trademarks for medicinal products

Consumers are looking at medicinal product trademarks with greater precision. Because these products have an effect on health, the issue of similarity between trademarks for products on this kind is not always considered in the same way as trademarks for goods and services in other industries. In the case of medicinal products and pharmaceuticals, even slight differences in brand names might be important. This was the standpoint adopted recently by the Supreme Administrative Court , which stated that even a change of merely the last two letters of a mark can be significant. The court also found that in the case of medicine, a name that combines the name of the main chemical ingredient of the medicine in question or name of an illness for which the medicine is intended with certain prefixes or stereotypical endings is a fanciful name.

When a business party applies for a trademark in bad faith

Applying for a trademark that is identical to or resembles (with respect to a key element of distinctive character) marks held by a different business undertaking once a business relationship has ended is application made in bad faith.

Merely providing proof of reputation of a trademark is not sufficient

The Supreme Administrative Court in Warsaw has confirmed in a recent judgment that in a court case there is a requirement to prove that a trademark is a trademark with reputation – the judgment comes in a case concerning a claim for invalidation of a trademark.
