Bio

Piotr’s practice focus is copyright, civil litigation and legal issues surrounding AI. At TKP, he is part of the Copyright and AI team. He also focuses in his work on industrial property, competition, and private international law. Piotr has ten years of experience advising on copyright law, on matters such as collecting society issues, comprising advising on numerous litigation cases, alternative dispute resolution negotiations, and drafting agreements and legal opinions.

He has conducted many training sessions on copyright law, on issues such as AI in copyright law.

He has also authored publications on copyright law.

Piotr studied at the Faculty of Law and Administration at the Jagiellonian University, and is admitted to the bar in Kraków.

He speaks English, German, and Hebrew.

AI training and opt-out mechanisms for EU copyright holders - still more questions than answers 

AI model training requires enormous amounts of data, which include copyright-protected materials. The EU has introduced an exemption to the reproduction right, which permits the reproduction of works for the purposes of text and data mining (TDM). What was not immediately obvious was that the TDM exemption applies to AI training, as the Digital Single Market (DSM) Directive does not mention AI. However, there no longer seems to be any dispute about its applicability.

Disclosure obligation under art. 19 of Directive (EU) 2019/790 and the proposal for transposing it in Poland

Work on a Polish legislative proposal for transposition of the Directive on copyright and related rights in the Digital Single Market (Directive 2019/790)[1] is still at an early stage, even though the deadline for transposition has passed. As the process to enact the legislation proceeds, this is a good time to look at the proposal for the provisions that realize the transparency obligation (art. 19 of the Directive). The new rules will have a major impact on the relationship between holders of economic copyright and those making use of it.
