Bio

Xawery Konarski is a legal expert with more than twenty years of experience in new technologies. He is a Senior Partner and co-founder of the Traple Konarski Podrecki & Partners Law Firm, where he supervises the Technologies Media Telecommunications (TMT) Practice, coordinating projects in Poland and Central and Eastern Europe.

Xawery Konarski serves as Vice-President of the Polish Chamber of Information Technology and Telecommunications (PIIT) as well as President of the New Technologies Law Association (SPNT). He also acts as a legal adviser to the Internet Adverstising Buerau Polska and the Polish Chamber of Insurance (PIU). Furthermore, he is a member of the Sectoral Council for Telecommunications and Cybersecurity.

As a legal expert, Xawery Konarski has participated in the legislative work on a number of laws in the field of new technologies. He provides legal support to clients providing online services for projects involving the implementation of the Digital Services Act.

He is an arbitrator for the Arbitration Court for Internet Domains at the PIIT.

He is also a member of such organisations as the International Association of Privacy Professionals (IAPP), the International Network of Privacy Law Professionals (INPLP), the International Technology Law Association (ITechLaw), and SABI-IOD (SABI Data Protection Officer Association).
Over the last seventeen years Xawery Konarski has been repeatedly recommended in Polish and international rankings of lawyers specialising in TMT and data protection (including Chambers Europe, Legal 500, and Rzeczpospolita).

He has won awards such as the Michał Serzycki prize awarded by the President of the Personal Data Protection Office for distinguished achievements serving to expand knowledge on privacy and the role played by data protection in many disciplines and communities.

Editor-in-chief of Kwartalnik Prawa Nowych Technologii published by C.H.Beck.

He is the author of several academic publications in the field of new technologies and personal data protection law.

He teaches post-graduate courses the field of new technologies and personal data protection law.

We are pleased to announce that today Xawery Konarski was elected Vice-President of the Polish Chamber of Information Technology and Telecommunications (PIIT) for the 2023-2026 term. Andrzej Dulka was re-elected as President of the Management Board, and Marta Broza (Orange Polska), Jacek Falkiewcz (Ericsson), Mirosław Śmiałek (Polkomtel), Wiesław Paluszyński (E-Konsulting) and Teresa Wierzbowska (Cyfrowy Polsat) became Vice-presidents.

The Polish Chamber of Information Technology and Telecommunications is the oldest chamber of commerce in Poland associating Polish and foreign ICT companies, celebrating its 30th anniversary this year.

User Content Moderation under the Digital Services Act – 10 key takeaways

One of the main objectives of adoption of the EU Regulation – the Digital Services Act (DSA) was defining the rules on content moderation by digital service providers. On the one hand, the DSA defines the procedure for and consequences of moderating or not moderating content, while on the other hand it also lays down the rights of users when their content is moderated. The fulfillment of these requirements has direct implications firstly with respect to the possible civil or criminal liability of intermediary service providers for distributing others’ content of an illegal or harmful nature, and secondly with respect to administrative liability under the Digital Services Act (e. g. a financial penalty imposed by the Digital Services Coordinator under Article 52(3) of the DSA).

Digital Services Act - the legal status of implementation in Poland

On October 19, 2022, one of the most important pieces of Internet legislation in the last two decades, the Digital Services Act, was passed. The DSA went into effect on November 16, 2022. The vast majority of its provisions will be effective as of February 17, 2024 (Article 93(2)). The implementation of the DSA will require European Union countries to enact legislation that defines the competencies of bodies that act as Digital Services Coordinators, responsible for overseeing the enforcement of the DSA (Article 49).
